Supreme Court Justice Samuel Alito has moved up by a day a key deadline for filing of briefs in a key case of election fraud in Pennsylvania.
Alito had originally called for response arguments by 4pm Wednesday but has moved the deadline up by more than 24 hours to Tuesday 9am.
Importantly, Tuesday is the “safe harbor” deadline that requires controversies surrounding elections to be ended so states can finalize their electors for the Electoral College on Dec. 14.

The Tuesday, Dec. 8 deadline could be a signal that the Supreme Court takes up Kelly’s case, which was shot down by the Pennsylvania Supreme Court last weekend.
The lawsuit, brought by a group of Republican lawmakers and candidates led by state Rep. Mike Kelly, alleges Pennsylvania’s vote-by-mail statute – Act 77 (which vastly expanded the state’s mail-in voting procedures) is in violation of Pennsylvania’s constitution.
The judge in the case, Pennsylvania Commonwealth Judge Patricia McCullough, blocked certification of the state’s election results in the case last month and that the petitioners in the case “appear to have established a likelihood to succeed on the merits.”
