Maricopa County Judge Dismisses Lawsuit Over Subpoenas for Dominion Voting Machines – Says Lawmakers Can Re-File

An Arizona Superior Court Judge has dismissed a lawsuit brought by Republican lawmakers who subpoenaed Arizona Dominion voting machines.

The suit by Arizona Senate President Karen Fann and Senate Judiciary Committee Chairman Eddie Farnsworth sought to force Maricopa County officials to comply with their subpoena. County officials voted last week to refuse to make the voting machines available for a forensic audit.

Maricopa County Superior Court Judge Randall Warner dismissed the case saying it was not a “proper remedy” for getting government officials to comply.

He said Arizona law allows officials to be held legislative contempt if they don’t perform their duties, which can lead to arrest by the sergeant-at-arms.

The Arizona state legislature is currently not in session.

Warner, however, did suggest the state senators could file the case again with a “plausible argument” under a law that deals with the enforcement of subpoenas issued by public officers.
