Attorney for President Trump Jenna Ellis emphasized the power to choose electors who vote in the Electoral College for president and vice president is solely that of state legislatures, as codified by the U.S. Constitution.
Ellis made the remarks in a hearing before Arizona state legislators today on election fraud.
Citing a Supreme Court case, McPherson v Blacker, Ellis said legislators have the legal footing and precedent necessary to choose the state’s electors if needed. The case, decided in 1892, found that state legislatures have “exclusive power to direct the manner in which the electors of President and Vice President shall be appointed.”
