Georgia Judge Dismisses Powell Kraken Lawsuit – Says Plaintiffs Waited Too Long to File

A federal judge has dismissed a lawsuit brought by attorney Sidney Powell that sought to decertify Georgia’s election results due to widespread voter fraud.

Judge Timothy Batten, who was appointed by George W. Bush, dismissed the suit on the grounds that the plaintiffs waited too long to file their motions. The suit could have been filed, Batten said in a ruling from the bench, when the allegedly fraudulent Dominion voting machines were first installed in Georgia, months ago.

“Instead they three weeks after the election,” Batten said. Batten did not say Powell could have presented evidence of voter fraud that had not taken place yet.

Batten also found the matter raised by Powell et al, are state issues, and that no mechanism exists for his federal court to grant them the “extraordinary” relief they sought.

The ruling came hours after an Obama-appointed judge dismissed Powell’s similar lawsuit in Michigan.
