Bill Proposed In New York Authorizes Quarantine Camps, “Removal And/Or Detention” of Individuals Deemed Public Health Risks, Mandatory Medical Exams & Vaccinations

A bill proposed in New York would give state officials power to remove and detain individuals deemed public health risks, and would even mandate medical examinations and vaccinations.

Assembly Bill A416 would give the governor of the state, in consultation with the health commissioner, the power to order the “removal and/or detention” of any person or group of people who pose an “imminent and significant threat to the public health.”

The determination of such a threat would be the sole purview of the governor, health commissioner, heads of local health departments or any delegee of the governor.

The bill would give officials the authority to mandate such individuals be quarantined in any medical facility that the governor designates or at their homes.

Additionally, the bill authorizes the mandatory “testing or medical examination of persons who may have been exposed to or infected by a contagious disease,” and “requires an individual who has been exposed to or infected by a contagious disease to complete an appropriate, prescribed course of treatment, preventive medication or vaccination” [emphasis added].
